These Terms of Service ("Terms") govern your access to and use of the services provided by Telloom ("Telloom", "we", "us", or "our"), including our website, web application, and related tools (collectively, the "Services").
By creating an account, acting as a Sharer, Executor, or Listener, uploading or recording content, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Who We Are
These Terms are between you and:

You must be able to enter a binding contract (for example, be at least the minimum age of majority where you live) to use the Services as a Sharer or Executor.
2. Key Roles and Definitions
The platform is designed around individual storytellers and their chosen audience. Access is not based on a single "family hub" but on each Sharer's own decisions.
"Sharer"
An individual who records or uploads stories, videos, audio, photos, documents, or other materials to the Services ("Content"), and controls who can view that Content.
- Sharers must be at least 18.
"Executor"
An individual that a Sharer designates to help manage that Sharer's Content and account settings.
- Executors have the same rights and controls over that Sharer's Content as the Sharer, except where explicitly limited in these Terms (e.g., synthetic avatars/voice consent).
- Executors are tied to individual Sharers, not to a family or group "space."
- A Sharer can revoke an Executor while the Sharer is alive. After a Sharer's death or incapacity, the Executor may continue to act as described in these Terms.
"Listener"
An individual invited by a Sharer or that Sharer's Executor to view specific Content.
- Listeners must be at least 18.
- Listeners only see Content that has been explicitly shared with them.
3. Eligibility and Accounts
3.1 Eligibility
- All users (Sharers, Executors, and Listeners) must be at least 18 years old.
- By using the Services, you represent that you meet the applicable age requirement and have the authority to accept these Terms.
3.2 Account Registration
To use significant parts of the Services, you must create an account. You must:
- Keep your login credentials confidential
- Notify us promptly at hello@telloom.co if you suspect unauthorized access
- Be responsible for all activity that occurs under your account
4. Roles, Access, and Control
4.1 Sharers
Sharers control:
- Which Content they record or upload
- Who can view their Content (by inviting Listeners and/or Executors)
- When to revoke access for Listeners and Executors
- When to delete specific Content or their entire account
4.2 Executors
For each Sharer:
- That Sharer's Executor(s) have the same rights as the Sharer to manage Content and sharing settings
- Executors cannot override a Sharer's explicit choice not to allow synthetic narration or synthetic avatars
- After a Sharer's death or incapacity, Executors continue to manage that Sharer's Content
4.3 Listeners
- Listeners may view Content shared with them and download copies for personal use
- If access is revoked, Listeners can no longer view Content in the Services (but this does not affect copies already downloaded)
5. Ownership of Content and License Grants
5.1 Content Produced by Telloom
For interviews and recordings produced by Telloom (when a Telloom-arranged interviewer uses Telloom equipment):
- Telloom owns all rights in the master recordings
- The Sharer receives a perpetual, non-exclusive, non-transferable, worldwide, royalty-free license to access, view, and download copies for personal, non-commercial purposes
- The Sharer may not use Telloom-produced recordings in commercial products without Telloom's prior written permission
5.2 Content You Upload or Commission Independently
For content you create yourself or commission independently:
- You retain ownership of the underlying content you upload
- By uploading, you grant Telloom a non-exclusive, worldwide, royalty-free license to host, process, and use the content to provide the Services
6. Synthetic Narration and Avatars
Telloom may in the future offer synthetic narration in your voice or synthetic avatars. These features are not currently active, but the rules for consent are:
- Only the Sharer can grant or withhold consent for synthetic narration or avatars
- Consent is obtained via explicit opt-in
- If a Sharer opts out or does not provide clear consent, we treat that as no consent
- Executors cannot override a Sharer's "no" to synthetic features
7. Responsibilities and Consent for Included Individuals
If you record or upload Content that includes other people (including minors):
- You represent that you have obtained any consent required under applicable law
- You have the right to grant Telloom the licenses described in these Terms
- You are responsible for informing those individuals that their stories will be stored via Telloom
8. Payments, Subscriptions, and Refunds
8.1 Recording Packages and Access
Telloom may offer recording packages that include a recording session and a defined period of access (generally 1–3 years). After the initial period, continued access may require an ongoing subscription.
8.2 Refunds and Cancellations
- Before Recording: If you cancel at least 24 hours before the scheduled session, you may be eligible for a refund or rescheduling
- After Recording: Payments are generally non-refundable once the recording session takes place
9. Access Loss, Retention, Exports, and Deletion
9.1 Loss of Access for Non-Payment
If a Sharer's paid access ends:
- Sharers, Executors, and Listeners will lose viewing access to Content
- The Sharer or Executor will have a grace period of up to six (6) months to log in and download Content
- During this period, only the Sharer or Executor may access the account
- After this period, Telloom may delete the Content with no further obligation
9.2 Export Rights
While an account is in good standing, Sharers and Executors may export Content using the tools we provide.
10. Acceptable Use and Content Standards
You agree not to use the Services to:
- Create, upload, or share Content involving non-consensual sexually explicit material or exploitation
- Constitute harassment, credible threats, or serious abuse
- Violate applicable law, including privacy, publicity, or intellectual property rights
- Attempt to hack, disrupt, or overload our systems
- Circumvent access controls or attempt unauthorized access to others' Content
11. AI Services and Model Training
To provide transcripts, summaries, search, and other features, Telloom uses third-party AI services, which may include:
- OpenAI (e.g., GPT-based models)
- Anthropic (e.g., Claude)
- Google (e.g., Gemini)
By using the Services, you acknowledge that:
- Content may be sent to these providers for processing
- These providers may use submitted data in accordance with their own terms, which may include training and improving their models
- Telloom does not currently offer an opt-out for such AI training at the provider level
12. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Disclaimers
To the maximum extent permitted by law:
- The Services are provided on an "as is" and "as available" basis
- We do not guarantee that recordings will be free from all technical issues
- We do not guarantee that transcripts or summaries will be error-free
We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the maximum extent permitted by law:
- Telloom will not be liable for indirect, incidental, special, consequential, or punitive damages
- Our total aggregate liability will not exceed the amount you paid to Telloom in the twelve (12) months preceding the event, or $100 if you have not paid anything
15. Indemnification
You agree to indemnify, defend, and hold harmless Telloom from any claims, liabilities, damages, losses, and expenses arising from your use of the Services, your Content, or your violation of these Terms.
16. Termination and Suspension
We may suspend or terminate your access if you violate these Terms or engage in conduct that may harm Telloom or other users. Upon termination, your right to use the Services stops immediately.
17. Changes to the Services and Terms
We may modify or discontinue parts of the Services and update these Terms from time to time. When we make material changes:
- We will update the "Last updated" date
- We will provide notice within the app and/or via email
- Where required, we will request your explicit acceptance within the app
18. Governing Law and Arbitration
These Terms are governed by the laws of the State of New York. Any disputes will be resolved by binding arbitration rather than in court, except for small claims court matters.
You and Telloom agree that all disputes will be resolved on an individual basis and waive any right to bring or participate in class actions.
19. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, form the entire agreement between you and Telloom
- Severability: If any provision is held invalid, it will be limited to the minimum extent necessary
- Assignment: You may not assign these Terms without our consent
